Use of consumer fireworks restricted; special permits.
- General prohibition. No person shall ignite, discharge, or use consumer fireworks in the township, except as provided in this section. Unless specifically authorized by this section or special permit, no fireworks shall be ignited on any date before 11:00 a.m. or after 11:45 p.m.
- On private property. Provided that no township burn ban is in effect, persons in the township may ignite, discharge, or use consumer fireworks on private property owned or controlled by that person, or with the owner's permission:
- On December 31, from 11:00 a.m. until 1:00 a.m.
- On January 1, from 11:00 a.m. until 11:45 p.m.
- On the Saturday and Sunday immediately preceding Memorial Day, from 11:00 a.m. until 11:45 p.m.
- On June 29 through July 4, from 11:00 a.m. until 11:45 p.m.
- On July 5, if that date is a Friday or Saturday, from 11:00 a.m. until 11:45 p.m.
- On the Saturday and Sunday immediately preceding Labor Day, from 11:00 a.m. until 11:45p.m.
- On public property. No person shall ignite, discharge, or use consumer fireworks on any public property within the township at any time, including on any public street, township park, or at any public access spot with access to either Little Paw Paw Lake or Paw Paw Lake.
- By special permit. Any township resident or guest wishing to ignite consumer fireworks on any date or at a time not authorized in this section may apply to the township for a special permit authorizing the event. The application for permit, and the resulting permit if issued, shall include the exact time, date authorized for the display and the type of firework that may be ignited.
Safe use required; purchase by minors prohibited.
- No person shall recklessly endanger the life, health, safety, or well-being of any person and/or property by the ignition, discharge, or use of consumer fireworks. No person under the age of 18years shall purchase any consumer firework in the township.
Violations and penalties.
- Any person violating the provisionsof thisarticle shall be guilty ofa civilinfraction, punishable by a fine of $100.00 for the first offense, $200.00 for the second offense and $400.00 for every offense thereafter.
